| 摘 要： | 大学生自杀是一个现实而严峻的问题,其原因复杂多样。深刻的社会成因是诱使大学生自杀的重要外因,它为正确认识其中所涉及的法律问题提供了社会背景和理论价值。有人认为大学生自杀是自我“自杀权”的实现,这是一种片面和狭隘的观点,“理性自杀权”才是法律不排斥的权利。应依据《学生伤害事故处理办法》来讨论和界定大学生自杀的归责原则和高校应否承担法律责任等法律问题。

| Abstract: | College students' committing suicide is a realistic and serious problem which is caused by various issues. The deep social origin cause of formation, which is an important external cause luring college students into committing suicide, provides social background and theoretical value for studying the legal problems involved in a right way. Some people think that college students' committing suicide is the realization of their own "suicidal right", which is an unilateral and narrow viewpoint. It is 'the rational suicidal right" that is accepted by laws. We should discuss and define the principle of responsibility ownership, and decide whether colleges should take legal responsibility, etc., by referring to the "Ways of Handling Accidents of Students' Injures". |
