| 摘 要： | 在我国著作权立法上,单位优先使用权具有创见性。由于英美法系和大陆法系国家无类似制度可考,且我国学界对其重视的力度不够,导致司法实践出现了诸多问题。因此,从宏观上认识单位优先使用权的性质和法理依据,对解决单位优先使用权导致的权利冲突,进而构建和谐的权利体系具有积极意义。

| Abstract: | In our copyright legislation, the right of unit priority remains innovative. Because the common law and civil law countries have no similar systems to draw lessons, and our scholars have not given it enough attention, a lot of problems occur in judicial practice. So, in order to have a clear idea of units priority's nature and legal basis from a macro awareness of the right, it is expected to solve the conflict caused by the priority, so as to build a harmonious system of rights. |
