| 摘 要： | 我国的工伤保险赔偿的水平低于普通人身损害赔偿的水平，由此产生了很多困境。目前应在考虑工伤保险制度的价值和劳动者权益的基础上建立以替代模式为主．以补充模式为辅的工伤赔偿模式。待社会经济发展到一定程度，工伤保险赔偿的水平得以大幅提高后再建立完全的替代模式。回归到工伤保险制度的价值追求上。

| Abstract: | As the level of general personal injury damages is higher than the levd of work injury insurance in our country, resulting many predicaments,we should take account of the system value of work injury insurance and rights of works, and then adopt relying substitution mode as a rule and supplement mode as a complement. When our society economicy developed, work injury insurance compensation carries to a new and higher level, we could take the absolute substitution mode to return the system value of work injury insurance. |
