| 摘 要： | 当今法理学基本问题主要包括 3个 :法律是什么 ?法律应该是什么 ?如何认识法律 ?前 2个问题是法律的本体论问题 ,后 1个问题则是法律的认识论问题。法理学也经历了一个与哲学类似的从本体论到认识论 ,再到语言哲学的转变过程 ,其中主线条就是对上述 3个问题的回答。这种知识谱系的讨论对于进一步深化我国法理学的研究 ,对于我们正确认识法治建设中存在的问题以及解决方式 ,无疑具有重要意义。

| Abstract: | The basic issues of today's Jurisprudence include:What is law?, What law ought to be?, and How to understand law?. The former two relate to the ontology of law, while the latter relates to the epistemology of law. Like Philosophy, Jurisprudence has been experiencing the transformation from ontology to epistemology, then to linguistic philosophy. What makes the line running through this transforming process is the answer to the above three questions. The discussion on the knowledge pedigree is of great importance to deepen the research of Jurisprudence, and understand the problems and solutions to them in the construction of rule of law. |
