| 摘 要： | 刑罚目的是刑法理论中的一个极为重要的问题。然而在这一问题上的认识却非常混乱。本文将从目的理论的一般含义和刑罚目的的界定来引出所要论述的刑罚目的。在回顾了刑罚目的理论的中西历史发展之后,本文评析了当前我国理论界的主要分歧,围绕“惩罚和改造不是刑罚目的”、“刑罚不能消灭犯罪”、“报应主义不应成为刑罚目的”以及“刑罚目的不应有根本目的和直接目的的划分”等观点展开阐述,进而提出只有预防犯罪才是刑法应有之目的的观点。最后指出,应理智地看待刑罚在预防犯罪中的作用,同时对刑罚的消极作用也作了警示。
