| 摘 要： | 现行人民检察院的机构设置没有充分体现行政检察的宪政定位及其职能。设置专门的行政检察机构,能够对行政处罚进行刑事法律监督,保障审计、监察行政内部监督程序与职务犯罪侦查程序的衔接,弥补我国行政监督制度空白,预防职务犯罪。专门行政检察部门必须处理好与反贪污贿赂、反渎职侵权、侦查监督和职务犯罪预防等部门的关系。
