在司法过程中,法官应严格服从法律还是可以创造性地解释法律,这是长久以来困扰我们的问题.对法官而言,服从法律是当然职责,同时也应融人创造精神,因为法官发挥其创造力的最终目的就是要更好地体现对法律的服从,在这种宗旨之下,法官的创造力就不会偏离法治的轨道.这些最终都需要通过法官对各种具体法律方法的运用才能得以实现.

A Dilemma of Legal Interpretation: Obedience or Creativity--A study of legal method

There is a dilemma in the judicatory,whether the judge should obey the laws strictly or he could interpret the law in a creative way.Obedience is the responsibility to the judge;meanwhile,creativity should be included in obedience.The judge uses his creativity in order to obey the law;therefore,the creativity of judge could not be the departure from the rule of law.Certainly,above all depend on the use of all kinds of methods of law.
