| 摘 要： | 近年来,在犯罪成立的问题上,有些学者主张推翻传统的平面型四要件理论,用德日的阶层型理论取而代之.但是所谓的四要件理论的缺陷是否不可弥补?事实上,只要不把该理论作"一存俱存,一失俱失"的理解,打破德日的阶层型理论的话语霸权,采取"分析地成立,系统地综合"的思路,问题就可迎刃而解.

| Abstract: | In recent years,some scholars claim that the theory of "four constitutive elements" should be replaced by the theory of "three constitutive elements" for there are some unconquered defects in the theory of "four constitutive elements".The author disagrees with this claim.Once the theory of "four constitutive elements" is not misunderstood,and takes the thinking of "respectively validated,and systematically constructed",the problem can be solved. |
