| 摘 要： | 我国的精神损害赔偿制度历经从无到有,由简单逐步走向成熟的发展过程,现已成为民法理论和实务界研究和探讨的重要话题。本文欲从精神损害赔偿的概念、性质及权利主体现状评析的基础上,提出该制度关于权利主体方面存在的问题及司法实践中确定权利主体范围的初步构想。

| Abstract: | The spirit damage compensation system has experienced from none to ens and from simplicity to maturation in China and now has been an important topic for the law society. This article tries to analyses the spirit damage compensation from its concept, characters and situation of main body and brings forward problems about the spirit damage compensation and thoughts to form main body injustice practice. |
