侦查行为的哲学方法论基础

在哲学的范畴中,事物矛盾原理和辩证否定原理等哲学方法论对于刑事侦查具有广泛的指导意义。其中,事物矛盾原理的侦查方法论价值在于涉嫌犯罪要件及其侦查总是共性与个性、同一性与斗争性、内部根据与外部条件的统一体,且矛盾分析法为涉嫌犯罪侦查的基本方法;而辩证否定原理的侦查方法论价值则体现在侦查机关及侦查人员对犯罪嫌疑人及其涉嫌犯罪行为一直处于不断的肯定和否定的过程中,其否定应符合自我否定的辩证法,且总与肯定相联系,而肯定与否定是相承续的。
