预防与制止家庭暴力的法律思考

家庭暴力是一个全球性的社会问题。它不仅破坏了婚姻家庭的稳定,同时也污染了社会环境,破坏了社会公德和家庭美德,甚至践踏了法律的公平与正义。目前世界各国对此纷纷采取必要措施,加强立法。近年来,我国对这一问题给予了重视,一些地区已经或正在制定地方性立法。本文从对家庭暴力的一般性分析出发,借鉴国外的立法经验,针对我国的实际情况提出了立法建议。

Domestic violence is a global social problem.It not only undermines marriage and family stability,but also pollutes the social environment,destructs social morality and family values,and even tramples on the legal fairness and justice.At present,many countries have taken the necessary measures to strengthen the legislation.In recent years, China pay attention to the issue that some areas have already established or are establishing local legislation.Based the general analysis on domestic violence and referring to foreign legislative experience, the paper put the legislative proposals in view of the actual situation of China.
