| 摘 要： | 刑法适用方法的运用是增强判决公正性和说服力的重要保证。在刑法适用方法研究中,刑法解释方法理论成果最多,研究的深度和广度都是其他方法无可比拟的。对于刑法适用中的思维方法、推理、论证、利益衡量方法以及刑法漏洞的处理方法等问题,虽有一定的研究成果,但与司法实践的要求相比还存在不足。加强刑法适用方法研究,丰富刑法理论,是提高司法效率、实现司法公正的重要途径之一。

| Abstract: | The using of methods in the application of criminal law is the important guarantee to enhance impartiality and persuasive of ruling. The research achievement of criminal law interpretation is the most fruitful in the study of criminal law application methods. What is more, the research of which is the deepest and the most widely. The research of methods of thinking, reasoning, argumentation, interest measure and process loophole in criminal law and so on is insufficient, comparison with the requirements of the judicial practice. Further study of criminal law applicable method is one of the important ways to improve the judicial efficiency and justice. |
