网络域名与商标冲突原因及解决策略研究

域名与商标的冲突是网络时代必然出现的现象,如何预防和解决该冲突,既是国际社会关注的热点,同时也是难点.域名与商标具有各自的含义和价值,通过研究双方矛盾的具体表现形式,再结合域名和商标之间内在的联系和区别,我们不难找出冲突的原因所在.针对域名与商标的冲突,将其解决策略归为技术性策略和制度性策略两类,以期能够为在电子商务环境下,为解决或协调域名和商标间的争议提供一个参考的依据.

Research on the Reasons and the Strategy of Solutions of the Conflict between Network Domain Name and Trademark

It is inevitable phenomenon that appears conflict between domain name and trademark in the network times.How to prevent and solve this conflict,it is not only a hot issue which the international society focuses on,but also a difficult argument.The domain name and the trademark have respective meaning and value,by studying the concrete presentation of contradictory sides,and combination with intrinsic relationship and the difference of domain name and the trademark,we can easily discover the reasons of conflict.In view of the conflict between domain name and the trademark,this paper divides the strategy of solutions into two types:technical strategy and systemic strategy.The strategy solutions provides a reference to solute and coordinate the dispute between the domain name and trademark under the electronic commerce environment.
