| 摘 要： | 我国现行刑法中有关自首制度的规定存在不足。对自首的时间限定有重要的意义和价值;对于“准自首”的认定应本着立法精神,不宜做出不应有的限制性规定;翻供行为不影响自首成立。

| Abstract: | The paper points out some problems and shortcoming of the surrendering oneself system in chinese present criminal law,the meaning and value of limiting the time of surrendering oneself.Judging the quasi-surrending should be on the basis of legilative spirit,not make undeserved limited megulations.The paper also demonstrates overthraing a confession does not affect the surrending oneself. |
