检察机关提起公益诉讼,是指检察机关以国家法律监督者的身份对涉及国家利益和社会利益而无人起诉的案件,向法院提起诉讼,要求法院依法判决有关违法行为无效,并追究有关当事人的法律责任的活动。我国虽尚未建立该项制度,但是域外的成功实践为我国构建检察机关提起公益诉讼制度提供了良好的借鉴,在我国建立检察机关提起公益诉讼制度存在必要性和可行性。
