| 摘 要： | 本文在对具体权利的性质和内容进行分析的基础上,借鉴其他国家立法,分别探讨了侵权场合及违约场合中精神损害的认定.精神损害制度适用领域在不断扩大,从人格权到身份权,再到特定的物权以及部分知识产权,最终超越侵权领域,承认特定的违约行为下的精神损害.但精神损害制度的适用是有限的,依然集中在与人格利益有密切联系的范围内.

| Abstract: | In judicial practice, the new type of case on compensation for mental damage has increasingly emerged, and the scope on mental damage being asked by the party is widening. On what occasion did the party suffer from mental damage and should be given the compensation? Based on the analysis of the essence and content on the right, the author discusses the definition of mental damage on the occasion of tort and breach. |
