| Abstract: | The paper points out the lacuna and summarizes the main issues experienced in judicial practice in China with regard to the shipper's rights of suit against the carriers under the contract of carriage of goods by sea; Then it gives a detailed analysis and examination to the related provisions in the 1992 COGSA; Based upon such a comparative study, the paper recommends legislative advice in respect of shipper's rights on the reformation of the Chinese Maritime Code. |
