| 摘 要： | 教唆犯问题历来是我国刑法学界研究的热点，这主要因为对其定罪处罚在我国《刑法》条文中体现很少，如何能做到罪行相适应，这是困扰我国《刑法》适用的一个难题。教唆型情节加重犯，这更是正确适用《刑法》所要分析和解决的问题，在理论和实践上都有重要的意义。
