| 摘 要： | 对于是否将被代理人的过错作为表见代理的构成要件,法学界存在多种观点。从国内外各种理论观点及其他国家和地区的立法例、司法实践中可以发现,"单一要件说"更具有合理性。当然,客观要件对确定表见代理也有影响,因而在认定是否构成表见代理时需就主、客观要件作全面分析。

| Abstract: | About whether negligence of the principal is the essential of agency by estoppels,there are three main theories.Through the comparative research of domestic and international theories,statutes and judicial precedents,the theory of "unilateral essential" is the best one.Of course,because objective essentials also influence the judge of the essentials of agency by estoppels,overall analysis of subjective and objective essentials is necessary for determining agency by estoppels. |
