INSTITUTIONALIZATION OF MEDIATION

Institution:Forrest S. Mosten is on the faculty of the UCIA School of Law and trains mediators and lawyers worldwide. A Certified Family Law Specialist and family mediator since 1979, he is the author of Complete Guide to Mediation, Unbundling Legal Services, and Mediation Career Guide;and has published numerous articles on conflict resolution and legal access. He is a frequent contributor to Family Court Review, has been guest editor for special issues on training mediators (January 2000) and unbundling legal services (January 2002), and is a popular presenter at Association of Family and Conciliation Courts (AFCC) Conferences. Abstract:Mediation has evolved, grown, and been accepted within our society from preschools to doctoral programs and in courts, legislatures, and private industry. The passage of the Uniform Mediation Act, the birth of the Association of Conflict of Resolution, and the involvement of government bodies in the regulation of mediators indicate the importance of the institutionalization of mediation within every aspect of our society. This article focuses on a few of the hot issues currently swirling in the field raising questions for practitioners, researchers, and others involved in shaping access to conflict resolution policy and the future of the mediation profession.
