宏观调控：宜政策化抑或制度化

制订"经济稳定法"具有必要性和可行性,以宏观调控政策的"前沿性、复杂性、技术性、和灵活性"等为理由反对制订该法的观点混淆了制度与政策的不同功能。其在调整目标上,除传统的"四大魔方"外,宜增加生态环境标准。在机构设置上,宜建立具有广泛代表性的专门委员会,使得中央和各地方、各行业都有合法的利益诉求平台。在实施机制上,应建立一致行动原则和违法审查机制。此外,该法也应尊重对私法主体的信赖保护。

On Macro-Regulation's Mechanism

Macro-control is a worldwide governmental policy to stabilize national economies.However,it is better to promulgate"macro-control law"to set up the standards and measures of macro-control so as to set macro-control policies in order and to avoid instabilities of macro-control policies.The main problem of China' s macro-policies lies in that local governments cannot always follow policies of the central government. Thus,it is urgent to enact macro-control law to ensure that the macro-control measures be obeyed at all levels.
