中国近代宪法学的诞生与成长

现代意义的宪法以及宪法学是西方社会的产物 ,在 1 9世纪 3 0年代前后开始传入中国 ,中国近代宪法学也在那个时期开始孕育和诞生。通过对民国时期出版、发表的宪法专著、译著、教材和论文的整理、分析 ,对几部代表性的宪法学作品的评述 ,以及民国时期中国宪法学的基本内容与主要特点的阐述 ,可以发现中国近代宪法学诞生与成长的经验和教训 ,并可以对繁荣新时期的中国法学提供借鉴。

The Birth and Growth of Chinese Modorn Constitutional Jurisprudence

The constitution and constitutional jurisprudence in modern sense is the product of the western society and began to spread to China in about 1930s. Chinese modern constitutional jurisprudence began to breed and emerge also at that time. By sorting out and analyzing the constitutional monographs, translations, textbooks and treaties that were published or issued in the Republic-of-China period, by commenting several typical constitutional works, and by expounding the fundamental contents and main characteristics of the Chinese constitutional jurisprudence in the Republic-of-China period, the experience and lessons of the emergence and growth of Chinese modern constitutional jurisprudence could be discovered, and the Chinese jurisprudence in the prosperous new period also could get some references.
