技术侦查与刑事诉讼目的的实现

技术侦查属于强制性侦查措施,具有技术性、秘密性和易侵权性的特征。技术侦查与刑事诉讼目的即惩罚犯罪与保障人权相平衡的实现密切相关。技术侦查立法应当体现程序法定原则、司法审查原则、比例原则和相关性原则的要求。我国技术侦查立法在措施使用范围、审查批准和执行机关以及审查程序等方面还有进一步完善的空间。

Technical Investigation and Realization of The Purpose of Criminal Procedures

Technical investigation belongs to compulsory measure with characteristic of technicality,secrecy and ease of right infringement.Technical investigation is closely related with the purpose of criminal procedure,that is,realization of balance of crime punishment and human rights protection.The legislation of technical investigation shall embody the requirements of principle of due process,principle of proportion and principle of relevance.There is still a much room for perfecting aspects of range of measures application,examination and approval,and enforcement organs as well as review process,etc.
