"出入境禁区"的立法问题--北京市出入境边防检查法治建设调研报告论要

便捷宽松的出入境政策是加强国际交流、推动本国经济的必由之路。开放与确保国门安全互为前提、缺一不可。依法治国要求不断完善出入境管理的法律法规,使之成为预防、控制出入境领域违法犯罪行为的利器和保障人权的屏障。本文着重讨论了出入境行政立法和刑事立法存在的问题,并提出完善我国这一领域立法的建设性意见。

Legislative Issues concerning Entry & Exit Forbidden Zone --An Outline of the Research Report on the Construction of the Legal System of Entry and Exit Border Inspection in Beijing

The loosening policy of entry and exit administration is undoubtedly an inevitable way to enhance international communication and to promote domestic economic development. Opening to the outside world and ensuring state security are interdependently presupposed and neither of them could be neglected. Managing state affairs by rule of law requires us to make constant efforts to perfect our laws and regulations in terms of administrative measures for entry and exit inspection, so that our laws and regulations will function as an efficient instrument to prevent illegal activities, and also as a protective screen for human rights. The article points out flaws in our administrative and criminal legislation and puts forward constructive suggestions in this regard.
