论受贿罪的共同犯罪

共同受贿犯罪,其主体之一必须是身份犯,其实行行为,则必须是利用职务之便实施的。身份犯互相勾结共同受贿,可以是简单共犯,也可以是复杂共犯。而为他人谋利则是客观要件,是实行行为。身份犯与家属相勾结,只能是复杂共犯,家属不能成为实行犯,其接受财物的行为只能是帮助行为,负从犯责任。
