| 摘 要： | 市场交易中存在的信息不对称,会导致逆向选择与道德风险等市场扭曲与失效问题,为此法律科以信息优势方以附随义务对其进行矫正与替代。就信息不对称与附随义务以及违反附随义务导致的缔约过失责任之间的关系以及缔约过失责任的范围等进行论述。
