| 摘 要： | 以安全与自由兼顾为评判标准,《爱国者法》是一部安全高于自由的反恐法律。具体表现为:禁止公民的表达自由,侵害了公民的宪法权利;软化司法令状,缩减了公民权利和自由的疆域;扩大侦查权力,挑战非法证据排除规则;规定无限拘留权和设立军事法庭,侵犯了公民的正当法律程序权;监听、监视监管场所,妨碍公民律师帮助权的实现。
