环境资源保护法人犯罪浅析

与普通刑事犯罪的一个显著的不同点在于,环境资源犯罪的主体主要是单位,我国刑事立法称之为单位犯罪(即法人犯罪)。1997年《刑法》专节设立了"破坏环境资源保护罪",增加了相应的单位犯罪主体,加强了对破坏环境资源犯罪的打击力度。但由于对环境资源法人犯罪的特点认识不足,现行《刑法》在环境资源犯罪方面的规定存在立法不合目的性,刑种设置不当等问题,深入分析环境资源法人犯罪的特点对完善环境资源刑事立法实有必要。

Analysis of the Juridical Person Offence against the Environment Resource Protection

One significant different point of the environment resource offence from the general criminal is that, the main body of the former is called the corporation offence (ie, juridical offence) by our criminal legislation. In 1997 the Criminal Law regulated the destroy environment resource protection criminal in a specific chapter, adding the corresponding corporation offence body, and enhanced the measures against the environment resource destroy criminal. However, due to the lack knowledge of the understanding the features of the environment resource corporation offence, the current Criminal Law has some problems in the regulation on the aspects of environment resource criminal, such as the legislation not in accordance with the target, the criminal classification setting not suitable. To deeply analysis of the features of the environment resource corporation offence will be necessary for the improvement of the environment resource offence legislation.
