| 摘 要： | 诉讼突袭与民事诉讼的基本理论和诸多制度、规则密切相关,与辩论主义、处分原则、心证公开等交错联结,这一问题的提出和展开将促使在微观层面深化对诉讼行为的研究以及民事诉讼审前程序、法官释名权的行使、诉讼促进义务等更为审慎的思考,最终为民事诉讼规则设置的完善和精细化提供理论上的阐释与支撑,乃至提供更为具体的思路方向与路径选择。
