从处分行为及占有角度对盗窃罪与诈骗罪及侵占罪界限再研究

盗窃罪、诈骗罪和侵占罪是侵犯公民财产几种较接近的犯罪形式,虽然三者在通常情况下主客观方面存有较大的差异,但在一些非典型案件中要区分这几种罪行,确实存在一定的难度。通过比较分析,对这三种犯罪行为进行深入研究,并综合探讨在一些特殊的犯罪形式下他们之间的区别,以求能够揭示出这几种犯罪的实质特征,以期对于司法实践中如何准确认定该三种犯罪有一定的指导作用。
