对现行房屋租赁登记备案制度的法律思考

摘    要:我国现行立法未能将房屋买卖与房屋租赁两类不动产的性质作明确区分,将登记备案亦规定为房屋租赁合同的生效要件。文章从制度设计的角度入手,分析了不动产租赁权的债权性质以及登记系不动产物权变动的公示方法。提出房屋租赁合同并不会产生不动产物权变动的效果,因而登记备案亦不会对合同的效力发生任何影响,旨在修正与完善现行法律中的相关法律制度。

Abstract:The prevailing laws in our county do not distinguish the nature of the house sales from house lease or take the registration as the requisite of effect of the contract. From the aspect of the system des-ignation, this article analyzes the credit nature of the right of real estate lease and the way of publishing the alternation of the real estate titles. This article puts forward that the house lease contract could not give rise to the alternation of the real right, so the registration contributes little to the effect of the contract. This article is to amend and perfect the related laws and regulations.
