TRIPS与我国新《商标法》在加强商标权保护方面的完善

商标权的保护是各国商标法的核心问题。强化对商标权的保护 ,是中国商标制度发展的关键。 TRIPS协议对中国知识产权的立法和执法都产生了重大的影响 ,我国于 2 0 0 1年 10月 2 7日通过的经第二次修改后的《商标法》,吸纳和借鉴了 TRIPS协议中的有关规定 ,增加了商标确权的司法审查程序 ;确立了商标行政诉讼第三人主体资格 ;明确了销售侵权责任 ;对侵犯商标权的赔偿数额做出了较详细的规定 ,便于司法审判机关实际操作 ;为及时有效地保护权利人的利益 ,规定了诉前临时措施 ;加强了行政机关的执法力度。从多方面完善了商标司法与行政执法 ,提高了商标保护水平
