我国劳动争议处理体制的评析

摘    要:本文通过对我国现行的“一协一调一裁二审”劳动争议处理体制的分析,指出其中存在的弊端。结合我国国情,提出了限制和解,改善和加强劳动调解制度,规范、健全仲裁制度,实行“裁审分轨”,以及建立劳动诉讼制度的建议,以完善我国劳动争议处理体制。

Abstract:The current disposal system of labor dispute, which refers to "one cohesion, one mediation, one arbitral and two trials", remains some shortages. This article, from the angle of law theory and judicial practice, combined with our country's situation, points out some suggestions such as restraining conciliation, improving and strengthening mediation, standardizing and perfecting arbitral system, carrying out the system of separating arbitral and trial and finally establish labor lawsuit system.
