| 摘 要： | 传统物权理论,将自然资源开发利用权的物权属性以特许物权或准物权的单一设置列入他物权。根据自然资源开发利用权权利的性质、功能以及客体的复杂性、复合性特点,其物权属性不是单一制的,应该以三分法:典型用益物权、典型自物权、准用益物权。在突破传统理论的障碍以后,认同自然资源开发利用权物权属性的三分制,是有效配置资源的保障。
