公共选择理论对我国法治政府建设的启示

公共选择理论作为一种政治的经济学,其独特的内容对我国法治政府建设具有重要的启示。公共选择理论认为人都是"经济人,"其政治行为和经济行为都是为了追求效用最大化,政府在干预经济社会的过程中存在着失灵现象,政府的行为往往会受到利益集团寻租的影响,而一些官员为了自利也会创租和抽租。

As a branch of political economy,public choice theory has aroused many controversies since the very beginning of its proposal.However,its unique perspective and content can shed light on the government legal construction in our country.Public choice theory believes every human being is an "economic agent".The very political and economic behavior of each agent is in pursuit of the maximization of effectiveness.There are failures and cases of malfunction in the process of government's interference in economic society.In most cases,the behavior of the government will be influenced by the interest-seeking groups.And some government officials will create or pull out rent for the sake of their own interest.Public choice theory and its direct impact on the choice and emphasis on rules and legislation can shed some light on the government legal construction of our country:we have to set up restraints for government according to legislation;we have to make the government behave responsibly and act according to the protocols;and we have to enhance the supervision over the power of the government.
