| 摘 要： | 随着中国加入 WTO,电子商务立法建设问题成为发展电子商务的一个必要前提直接关系到我国在未来的国际竞争中的地位。本文在总结借鉴国外立法实践的基础上 ,深入的探讨相关的合同法问题、网络环境下信息产品的知识产权保护问题及解决电子交易过程中当事人及其他相关人对自身行为合理谨慎的程度以及对网络空间中的公众所具有的侵权法问题。促进网上电子交易在整个国际贸易领域中发挥重要的作用。

With the reference from foreign legislative practice, the thesis discusses problems related with Contract Law, protection of online intellectual property right and carefulness of agents concerned and the problems concerning the tort law. |
