共有人与承租人优先购买权的竞合

摘    要:无论在客体和范围还是在前提和结果方面 ,处分共有份额与处分共有物均存在根本不同。根据我国现行法律的规定及基本法理分析 ,共有人的优先购买权与承租人优先购买权因客体性质和前提基础不一致而不会发生竞合 ,所谓二者的竞合实质上是一个不存在的问题 ,是人们想当然的思维惯性下的一种误解。在共有人转让共有份额时 ,承租人不享有优先购买权 ,承租人可寻求“买卖不破租赁”原则予以保护 ,当多数共有人要求转让共有物时 ,少数共有人基于对共有份额优先购买权有权收购多数共有人的共有份额。

Abstract:Concerning object-scope and premise-result, there is fundamental difference between the disposition of proportion in common and the disposition of community property. According to our regulation and basic legal principle, there is no concurrence of preemptive right between common proprietor and tenant, because they are not consistent in the nature of object and base of premise. It's only a misunderstanding in our mind but not a real item. When common proprietor conveys his proportion, tenant doesn't have preemptive right, but can search for protection by the principle "tenancy prior to deal". When the majority of common proprietors decide to convey community property, the minority have the preemptive right to buy their proportions.
