| 摘 要： | 在我国刑法中,判断一个行为是否构成犯罪要看这一行为的犯罪构成要件,而身份又与犯罪构成的各个要件都发生着密切联系,从而影响行为的社会危害性及其程度。在身份犯的修正犯罪构成中,身份不是犯罪的主体要件,无身份者同样可以符合身份犯的修正犯罪构成。

| Abstract: | In the Chinese criminal law,to judge whether or not a behavior constitutes a crime depends on the crime constitution elements of the behavior,while identity is closely related to each element of crime constitution,to affect the social harmfulness of behavior and its degree.Identity is not the subject conditions in the revised criminal constitution of identity crime.The person with no special status also can meet the revised criminal constitution of identity crime. |
