互联网著作权侵权案件管辖问题浅析

互联网著作权案件是网络时代产生的新型侵权案件 ,对传统侵权案件的管辖规则提出了挑战。最高人民法院为此颁布了《关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》 ,该《解释》的第一条就明确规定了管辖问题。该《解释》确立了新的管辖规则 ,解决了司法实践中的一个难题 ,对确立其他类型的互联网侵权案件的管辖具有一定的指导意义 ,但也存在一些不足之处。

Cases of infringement against copyright in Internet is a new type happening at the age of the network,Challenges the traditional jurisdiction over infringement.Therefore,People's supreme court made Explanation on Several Questions of Law Application in Computer-Network Related Copyright Issuss,in which the first article expressly provides it.It establishes the new rules of jurisdiction,solving a difficult problem in judiciary practice,and is significantly useful to decide jurisdiction over other type of infringement in Internet.Certainly,it has some drawbacks.
