新能源及可再生能源开发利用与环境资源保护的关系及其立法协调

新能源、可再生能源的开发利用与环境资源保护之间存在相互依赖、彼此制约的复杂关系。就整个产业过程而言,新能源与可再生能源的开发利用,在有些情况下并不能同时达到能源供给和环境资源保护的双重目的,需要在确保能源供给和保护环境资源两个目标之间作出权衡取舍。为此,必须在立法上处理好新能源及可再生能源开发利用与环境资源保护的关系,在制度上相互衔接配套,从而避免立法上的冲突和实施中的矛盾。

The relations between development of new energy and renewably energy and environmental resource protection are so complicated that they not only rely on but also be restricted with each other.In some cases,the two goals of the development of new energy and renewably energy,including energy supply and environmental resources protection,can not be achieved at the same time during the industry process.Then a choice has to be made to give up one of them.Thus,it is necessary to deal with the relations between development of new energy and renewably energy and environmental resources protection in legislation properly and let them support each other in system,so as to avoid the conflicts in both legislation and enforcement.
