中法民事审前准备程序之比较研究

我国的民事审前准备程序存在很大的问题，改革完善势在必行。对中法民事审前准备程序在法律框架、实践层面的比较，不难看出我国在制度上和实践中存在的一系列问题，这些问题的产生有其原因可寻。我国的审前程序建构不能冒进，而应该在现有法律制度的基础上，借鉴与我国法律文化相似国家的经验，根据我国的实际进行。
