| 摘 要： | 关于香港特别行政区（以下简称“香港特区”）政体特征，一直存在两种对立的观点，即行政主导和三权分立。香港特区政体既属于三权分立体制的范畴，又具有行政主导的特点。三权分立、行政主导是从不同角度对香港特区政体特征的描述，两者不是同一层面的事物，也不是割裂的关系。全面概括香港特区政体的特征，应是三权分立基础上的行政主导制。
