| 摘 要： | 现代国家都在宪法内明文肯定公民基本权利的存在和价值的同时,也或多或少规定了公民基本权利的限制问题。但如何在一个正确理念和价值观的引领下,使公民基本权利的限制和实现,能在法律的框架下得以完善的运作,无疑对宪政的形成和发展都有极其重要的意义。
