| 摘 要： | 在司法实践中,信用卡诈骗罪的认定还存在一些争议较大的问题。捡拾他人信用卡后通过自动取款机取款的行为应如何定性,抢劫、抢夺、诈骗他人信用卡并且使用的行为如何定性,以及冒用他人信用卡的冒用对象是否包括伪造的或作废的信用卡三个疑难问题值得进一步研究和探讨。

| Abstract: | In the judicial practice,there are still some controversial issues on the credit card fraud.In this paper,the author discusses three difficult questions:How to determine the nature of withdrawing money from the automated teller machine by using other people's credit cards,how to determine the nature of robbing, plundering or swindling other people's credit cards and using them and whether the objects counterfeited are forged or blanked out. |
