动漫角色商品化权保护

摘    要:商品化权是一种"二次开发"权利,是基于动漫作品中的动漫形象而产生的。而我国现有法律没有任何明确的依据可以加以规制,因此建立一种有效的独立保护模式是有必要的。本文从动漫形象的商品化过程分析入手,介绍了目前主要的知识产权保护模式并做出了评析,在此基础上探讨了独立的商品化权保护模式的构建。此种保护模式便是整合国家和企业知识产权战略部署的保护动漫角色商品化权的新的独立模式。

Abstract:Since animation character's merchandising right is a "secondary exploitation" right,which based on the commercialization of the animation works,there is not any clear and definite rule to punish such behaviors which are obviously not conducive to the healthy development of animation industry in the existing laws.It is necessary to build a powerful independent protection mode.In this paper,from the analysis of the commercialization process,the author introduces and comments on the main mode of protection based on the existing framework of intellectual property law.We should build a new protection mode which can protect animation Character's merchandising right through the integration of the national and enterprises' intellectual property strategic plan.
