| 摘 要： | 在不断坚持宽严相济刑事政策的司法语境下,完善我国的缓刑制度是极为必要的。目前,我国缓刑制度还存在适用形式单一、适用条件难以操作、执行流于形式,监管处于失控状态等不足。完善我国的缓刑制度,应当从缓刑的适用形式、实质条件、适用程序、考察制度、撤销制度等方面入手。

| Abstract: | Under the context of constantly insisting on the criminal policy of tempering justice with mercy,it is quite necessary to perfect our country＇s probation system.At present,there still exist some disadvantages that the applied form is monotonous,applied conditions is difficult to operate,execution is mere formality,and supervision is out of control.To perfect our country＇s probation system,it is necessary to take a research on its applicable form,essential requirements,applicable procedures,inspection system,and revocation system. |
