强化检察建议在实施法律监督中的作用

随着最高人民检察院《关于印发〈人民检察院检察建议工作规定（试行）〉的通知》（高检发[2009]24号文）的下发,原本缺乏明确定义和定位的＂检察建议＂迈入了一个新的发展阶段。作为一种非诉监督方式,检察建议在检察机关＂法律监督＂职能中的作用和意义再次成为研究热点。我国的检察建议,既存在着刚性需求,又面临着严峻挑战。从检察机关的主观能动性和实践操作性角度看,强化检察建议在实施法律监督中的作用仍大有可为。

On Function of Strengthening Procuratorial Suggestions in the Process of Legal Supervision

With the supreme people＇s procuratorate printing and distributing the Rules of People＇s Procuratorate＇s Procuratorial Suggestion（for trial implementation）,the procuratorial suggestions is entering a new stage of development which originally is a lack of clear definition and fixed position.As a way of procuratorial supervision,it has become a hot research topic.As to China＇s procuratorial suggestions,there are both rigid demand and challenges.From the subjective initiative and practice operational perspective of the procuratorial organs,it still has bright prospects to strengthen the procuratorial suggestions in the exercise of legal supervision.
