| 摘 要： | 中国在完善市场经济体制的过程中,需要对传统商事主体及商事主体法进行重新建构。这主要包括,按组织形式标准对商事主体进行重新分类,将国有企业定位于社会公益性主体,并以效益优先的理念重塑商事主体立法。
