| 摘 要： | 证券监管法律制度属于经济法的范畴,经济法的“社会性”本质同样是证券监管法律制度的本质。以此理论为基点,对我国证券监管的现状作出了实证分析,并阐明了完善证券监管必须从社会整体经济利益出发,合理界定政府监管权力和证券自律机构的权利。

| Abstract: | Stock supervision legal system belongs to the field of economic law. Sociality is the essence of economic law. It is also the essence of security supervision legal system. In the view of present condition of security supervision in China, to perfect it must base on overall economic benefits of the society, and define the power of government supervision and the right of security self-discipline institute properly. |
