An Analysis of the Utility Value of Penalty Deterring

Detering utility value of penalty refers to it's usefulness in realizing the penalty goals. It involves two issues; one is the direction of the penalty deterring, the other is the external performance of the penalty deterring. The author believes that the penalty deterring is inexpensive when preventing the crime . Compared with other penalty functions, it should be paid enough attention by the modern criminal law legislation and the criminal judicature.
